These Terms of Use (“Terms”) govern your access to and use of the Dealre website and related services (the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. These Terms are not legal advice; consult an attorney for advice regarding your specific circumstances.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services in a binding manner. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

Description of the Services

Dealre provides an online platform to browse property listings, learn about our team, submit inquiries, and request information related to real estate in the United States. Listings, photographs, descriptions, prices, availability, and other property details are provided for informational and marketing purposes and may be sourced from third parties or multiple listing services.

Nothing on the Services constitutes a commitment to sell, lease, or finance any property, or an offer capable of acceptance, unless a separate written agreement is executed by authorized parties.

Brokerage affiliation (New York)

Real estate brokerage services offered through or in connection with Dealre are provided in affiliation with the responsible licensed real estate broker [Rommel Vazquez - Broker]. Salespersons, associate brokers, and other agents who work with Dealre hold the real estate licenses required by applicable state law (including New York, where applicable) and perform services under the supervision, policies, and oversight of that responsible broker.

This disclosure is provided to help comply with New York State advertising and brokerage identification requirements. If you have questions about brokerage supervision, licensing, or the identity of the broker responsible for a particular communication or listing, contact us using the information on our website.

No professional, legal, or tax advice

Content on the Services is general in nature and does not constitute legal, tax, financial, insurance, or investment advice. Real estate transactions involve significant legal and financial consequences. You should consult qualified licensed professionals (including attorneys, tax advisors, lenders, and inspectors) before making decisions.

Fair housing

You agree not to use the Services to discriminate unlawfully or to post discriminatory content. Dealre complies with the federal Fair Housing Act and applicable state and local fair housing laws. We may remove content or terminate access that we reasonably believe violates these obligations.

Web accessibility (ADA)

Dealre is committed to making its website reasonably accessible to individuals with disabilities, consistent with applicable requirements under the Americans with Disabilities Act (ADA) and related state and local accessibility laws. As a technical reference for ongoing improvements, we aim to align with the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA where feasible.

User conduct

You agree not to: violate any law or regulation; infringe intellectual property or privacy rights of others; transmit malware, spam, or harmful code; attempt unauthorized access to our systems or data; scrape or harvest data in bulk without our prior written consent; impersonate any person or entity; or interfere with the proper operation of the Services.

Submissions and communications

When you submit forms, messages, or other materials (“Submissions”), you represent that your information is accurate to the best of your knowledge. You grant Dealre a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display Submissions solely to operate, improve, and respond in connection with the Services.

Do not send confidential information through unsecured channels unless we expressly agree to a secure process.

Intellectual property

Dealre and its licensors own all rights in the Services, including branding, text, graphics, layout, and software, except as otherwise indicated. You may not copy, modify, distribute, sell, or create derivative works from the Services except as permitted by law or with our prior written consent.

Listing content may be owned by listing parties or MLS participants and is displayed under applicable agreements. Unauthorized reproduction of listing data may violate third-party rights.

Copyright complaints (DMCA)

If you believe material on the Services infringes your copyright, send a notice to the contact email above with: identification of the work; identification of the allegedly infringing material and its location; your contact information; a statement of good faith belief; and a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner. We may remove or disable access to material in appropriate circumstances.

Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that listing information is complete, current, or error-free. Square footage, taxes, fees, school boundaries, and other data may be estimated or supplied by third parties and should be independently verified.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEALRE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID TO DEALRE FOR THE SERVICES GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnity

You will defend, indemnify, and hold harmless Dealre and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your Submissions, your use of the Services, your violation of these Terms, or your violation of third-party rights.

Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties.

Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Subject to applicable law, you agree that exclusive jurisdiction and venue for disputes will lie in the state or federal courts located in New York County, New York, and you waive any objection to personal jurisdiction or venue there.

If you are a consumer, nothing in these Terms limits rights that cannot be waived under applicable consumer protection laws.

Changes

We may modify these Terms at any time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, except where additional consent is required by law.

Miscellaneous

If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and Dealre regarding the subject matter and supersede prior agreements on that subject.
